These terms
These terms are an agreement between you and MaXsoft Technologies ("we", "us"), which runs Website is Up. By creating an account or using the service you accept them. If you use Website is Up for an organisation, you accept them on its behalf and confirm you are allowed to.
The service
Website is Up checks websites from our servers: whether they respond, whether key pages render, and whether journeys such as signing in or checking out still work. It tells you by the channels you choose when something fails, and, where it can, what changed just before.
Monitoring reduces risk; it does not remove it. Checks run at intervals, from a limited number of places, and a site can fail in ways no automated check sees. Keep your own backups and do not rely on Website is Up as your only safeguard.
Your account
- Give accurate details and keep them up to date.
- Keep your password to yourself. You are responsible for what happens under your account.
- Tell us straight away if you think someone else has access to it.
Acceptable use
You may only monitor sites you own, or that you have permission to monitor. Journeys and test logins need proof that a site is yours.
You must not:
- use Website is Up to test how much load a site can take, or to attack, probe or disrupt any site or network;
- try to get around plan limits, rate limits or the checks that prove a site is yours;
- use real customers' logins in journeys: use a test account made for the purpose;
- publish anything unlawful, misleading or infringing on a status page or report;
- try to reach parts of the service, or other customers' data, that are not yours.
We may suspend checks that are causing harm while we look into them.
Plans and payment
Plans, prices and limits are on the pricing page. Paid plans are paid in advance for each period, by card through Stripe or UBL. Prices include or exclude tax as shown at checkout.
When a paid period ends without renewal, your account moves to the free plan after a short grace period. Nothing is deleted when that happens: checks beyond the free plan's limits are paused, not removed.
If something went wrong with a payment, write to our contact page. Refunds are at our discretion, except where the law gives you a right to one.
Your content and data
What you put into Website is Up stays yours. You let us store and process it only to run the service for you, as the privacy notice describes.
A status page shows what you choose to publish. You are responsible for what it says about your clients' sites.
Changes to the service
We improve Website is Up continuously, which means features change. If we remove something you rely on, or change these terms in a way that matters to you, we will tell you by email in advance.
Warranties and liability
The service is provided "as is". We work hard to keep it running and accurate, but we do not promise that it will be uninterrupted, that every failure will be caught, or that every alert will arrive on time.
To the extent the law allows, we are not liable for lost revenue, lost profits or lost data, or for indirect or consequential losses. Our total liability for any claim is limited to what you paid us in the 12 months before it arose. Nothing in these terms limits liability that cannot be limited by law.
Ending the agreement
You can stop using Website is Up and close your account at any time. We may suspend or close an account that breaks these terms, and will tell you why unless the law prevents it.
Governing law
These terms are governed by the laws of the place where MaXsoft Technologies is established, and disputes go to its courts, unless the law where you live gives you the right to use your own.
